Agreeing to these terms
By downloading or playing Evochi you agree to these terms and to our privacy policy. If you don't agree, please don't use Evochi. Nothing in these terms takes away rights you have as a consumer under the law where you live.
Who can play
You must be at least 13 years old, or older if your country sets a higher age for using apps like Evochi without a parent's permission. If you're under 18, a parent or guardian should read these terms with you.
Your account
- You can play as a guest, in which case your progress lives only on your phone, or with an Apple, Google or email account, which lets you restore your Evochi on another phone.
- Keep your sign-in details to yourself. You're responsible for what happens in your account.
- An account is for one person and can't be sold or transferred.
Walk safely
- Evochi is a game. It is not a medical device and doesn't give medical advice. Your Evochi getting sleepy or sick is a game state based on game rules, not a judgement about your health.
- Talk to a doctor before starting a new exercise routine, especially if you have a health condition. Walk at a pace and distance that suit you.
- Pay attention to your surroundings. Don't play while driving or cycling, and don't go anywhere unsafe or where you're not allowed to be.
EvoCoins and items
- EvoCoins and in-game items (wearables, décor, snacks and herbs) are virtual. You get a limited licence to use them in Evochi; you don't own them.
- They have no real-world value, can't be exchanged for money, and can't be sold, traded or transferred outside the game.
- We may adjust prices, rewards and balances to keep the game fair and fun, and correct coins or items given by mistake.
- If we ever offer purchases with real money, the app store's terms, and any extra terms we show you at the time, will apply to them.
Fair play
Please don't:
- use devices, apps or tricks to fake steps, such as step-shaking gadgets or edited health data;
- exploit bugs, automate play, or modify, decompile or reverse-engineer Evochi, except where the law allows it;
- interfere with our servers or other players' accounts.
If we find rewards that came from cheating or a bug, we may remove them. Steps you enter by hand count towards XP and vitality but don't unlock chests or cosmetic rewards.
Names you choose
You name your Evochi. Names mustn't be hateful, harassing, sexual, or infringe someone else's rights. We may reset a name that breaks this rule. You keep the rights to what you write, and give us permission to store and display it in the game.
Our content
Evochi, its characters, art, music and software belong to [Studio legal name] or our licensors. We give you a personal, non-commercial, non-transferable licence to use the app on devices you own or control, under these terms and the app store's rules. If you send us ideas or feedback, we may use them without owing you anything.
Other services
Evochi works with services run by other companies, including Apple Health, Health Connect, Sign in with Apple, Google Sign-In and the app stores. Their own terms and privacy policies apply to them, and we aren't responsible for how they work.
If you use an iPhone
If you got Evochi from the Apple App Store, these extra points apply:
- This agreement is between you and [Studio legal name], not Apple. [Studio legal name], not Apple, is responsible for Evochi and its content.
- Apple has no obligation to provide maintenance or support for Evochi.
- If Evochi fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for Evochi.
- [Studio legal name], not Apple, is responsible for handling any claims about Evochi, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- If someone claims Evochi infringes their intellectual property, [Studio legal name], not Apple, is responsible for investigating, defending and settling that claim.
- You confirm that you aren't in a country subject to a US government embargo or designated as supporting terrorism, and aren't on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
Changes to Evochi
We keep improving Evochi, so features, items and balancing will change. We may also need to pause or stop parts of the service. If we ever shut Evochi down, we'll give at least [e.g. 60 days] notice in the app.
Ending this agreement
You can stop playing at any time and delete your data from Settings → Privacy & data, or through our account deletion page. We may suspend or close an account that seriously or repeatedly breaks these terms, and we'll tell you why unless the law or safety reasons stop us.
Disclaimers
We work hard to keep Evochi running and your steps counted correctly, but we provide it "as is" and can't promise it will always be available, error-free or that every step will sync. Step counts come from your phone and other devices, and we can't guarantee their accuracy. Where the law gives you warranties that can't be excluded, those still apply.
Limits on liability
To the extent the law allows, [Studio legal name] isn't liable for indirect or consequential losses, or for loss of virtual items, and our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and [e.g. USD 50]. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or anything else the law doesn't let us limit.
Governing law
These terms are governed by the laws of [country or state]. If you live in the EU, UK or another place with mandatory consumer protections, you also keep the protection of your local law and can bring claims in your local courts.
Updates to these terms
We may update these terms. If a change matters, we'll tell you in the app before it takes effect. If you keep playing after that, the new terms apply.
